1. Acceptance of Terms
Welcome to Sunyani Landscapes. By accessing or using our website, services, or products, you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all visitors, users, and clients of our landscape design services for luxury villas in Sunyani, Ghana.
Please read these Terms carefully before using our services. If you do not agree with any part of these Terms, you must not use our website or services. Your continued use of our website and services constitutes your acceptance of these Terms.
2. Description of Services
Sunyani Landscapes provides premium landscape design, installation, and maintenance services for luxury villas and properties in Sunyani, Ghana. Our services may include, but are not limited to, site analysis, concept development, detailed design planning, implementation, and ongoing maintenance of landscapes.
The specific services to be provided will be outlined in a written agreement between Sunyani Landscapes and the client. Any modifications to the services must be agreed upon in writing by both parties.
3. Intellectual Property Rights
All content on our website, including but not limited to text, graphics, logos, images, designs, and software, is the property of Sunyani Landscapes and is protected by copyright, trademark, and other intellectual property laws.
Design concepts, plans, and other deliverables created for clients remain the intellectual property of Sunyani Landscapes until full payment has been received, at which point the client is granted a license to use these materials for the specific property and project for which they were created. Reproduction, distribution, or commercial use of our designs beyond the scope of the original project is strictly prohibited without our express written consent.
4. Client Responsibilities
Clients are responsible for providing accurate information about their property, preferences, and requirements. Clients must obtain all necessary permits, approvals, and authorizations required for landscape implementation. Sunyani Landscapes may assist with this process but cannot guarantee approval from local authorities.
Clients must provide reasonable access to the property for site analysis, implementation, and maintenance. Any delays or additional costs resulting from restricted access or incorrect information provided by the client will be the client's responsibility.
5. Payment Terms
Payment schedules and terms will be outlined in the service agreement. Typically, our projects require a non-refundable deposit to secure our services, with subsequent payments tied to project milestones. Final payment is due upon completion of installation.
Late payments may incur interest charges and may result in suspension of services. Any disputes regarding invoices must be raised within 7 days of receipt. Prices are subject to change if the scope of the project changes or if there are unforeseen circumstances that significantly impact the cost of materials or labor.
6. Cancellation and Refund Policy
If a client wishes to cancel services after signing an agreement, the following terms apply:
- Cancellation before the commencement of design work: The initial deposit is non-refundable but may be applied to future services within 6 months.
- Cancellation during the design phase: The client is responsible for payment of all work completed to date.
- Cancellation during implementation: The client is responsible for payment for all work completed, plus any materials ordered or expenses incurred that cannot be canceled.
Sunyani Landscapes reserves the right to cancel or suspend services if a client breaches these Terms, provides false information, or fails to make payments as scheduled.
7. Warranty and Maintenance
Sunyani Landscapes provides a plant establishment warranty for a period specified in the service agreement, typically 30-90 days after installation. This warranty covers plant material failure due to defects but excludes damage caused by client negligence, pests, disease, extreme weather events, or improper maintenance.
Proper maintenance is essential for the long-term success of landscapes. We offer maintenance services under separate agreements. Clients who choose not to utilize our maintenance services must follow our provided care guidelines to maintain warranty coverage.
8. Limitation of Liability
Sunyani Landscapes shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from the use or inability to use our services. Our liability for any direct damages shall not exceed the total amount paid by the client for the specific project in question.
We are not responsible for damage to underground utilities, pipes, or structures that were not properly marked or disclosed by the client or relevant authorities. Clients are advised to have utilities marked before excavation begins.
9. Force Majeure
Sunyani Landscapes shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, extreme weather events, civil unrest, labor disputes, material shortages, or governmental actions.
In such events, we will make reasonable efforts to resume services as soon as practical and will communicate with clients regarding any necessary schedule adjustments.
10. Privacy Policy
Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
11. Dispute Resolution
Any disputes arising from these Terms or our services shall first be addressed through good-faith negotiation between the parties. If a resolution cannot be reached, the dispute shall be submitted to mediation in accordance with the laws of Ghana.
If mediation is unsuccessful, the dispute shall be resolved through binding arbitration in Sunyani, Ghana. The arbitrator's decision shall be final and binding on both parties.
12. Modifications to Terms
Sunyani Landscapes reserves the right to modify these Terms at any time. We will notify clients of significant changes by posting the updated Terms on our website and/or through direct communication. Continued use of our services after such modifications constitutes acceptance of the updated Terms.

14. Governing Law
